Acceptance of these terms

These terms of service form an agreement between you and IIRONIIC Media (operating as Myloe), based in Canberra, ACT, Australia. They govern your use of the Myloe mobile app, this website, and any related services we provide.

By downloading, accessing or using Myloe, you agree to these terms. If you do not agree to them, please do not use the service. If you are using Myloe on behalf of an organisation, you confirm that you have the authority to accept these terms for that organisation.

Eligibility

You must be at least 16 years old to create a Myloe account. Some venues and experiences recommended through Myloe are restricted to people aged 18 and over, and it is your responsibility to comply with any age restrictions that apply.

Your account

You need an account to use most of Myloe. When you create one, you agree to:

• Provide accurate and current information, and keep it up to date.
• Keep your login credentials confidential and not share your account with anyone else.
• Take responsibility for all activity that occurs under your account.
• Tell us promptly at contact@iironiicmedia.com if you believe your account has been accessed without your permission.

Acceptable use

When using Myloe, you agree not to:

• Use the service for any unlawful purpose, or in breach of any applicable law or regulation.
• Attempt to gain unauthorised access to our systems, accounts, or networks.
• Interfere with, disrupt, or place unreasonable load on the service or its infrastructure.
• Scrape, harvest, copy, or otherwise extract data from Myloe by automated means.
• Reverse engineer, decompile, or attempt to derive the source of any part of the service.
• Impersonate another person, or misrepresent your affiliation with any person or organisation.
• Submit content that is unlawful, misleading, defamatory, hateful, or infringes the rights of others.
• Resell, sublicense, or commercially exploit any part of the service without our written permission.

Recommendations and venue information

Myloe provides recommendations for restaurants, bars, activities, attractions, and other venues and experiences. These recommendations are suggestions only. We do not own, operate, or control the venues we recommend.

While we work to keep venue details accurate, we cannot guarantee that opening hours, pricing, availability, menus, or any other information is correct or current at the time you view it. You should confirm important details directly with the venue before relying on them.

Where Myloe links to a third party for bookings or reservations, that transaction is between you and the third party, and is governed by their terms and conditions. We may receive a commission on bookings made through affiliate links. This never influences whether a venue is recommended to you.

Intellectual property

Myloe, including the app, this website, the Myloe name, the sundial mark, all software, design, text, graphics, and the arrangement of them, is owned by IIRONIIC Media and protected by Australian and international intellectual property laws.

We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use Myloe for your own personal, non-commercial purposes, in accordance with these terms. All rights not expressly granted are reserved.

If you submit feedback, suggestions or ideas about Myloe, you grant us a perpetual, worldwide, royalty-free right to use them to improve the service, without any obligation to compensate you.

Privacy

Our Privacy Policy explains what personal information we collect, how we use it, and the rights you have over it. It forms part of these terms, and by using Myloe you agree to the practices described in it.

Service availability and changes

We work to keep Myloe available, but we do not guarantee that it will be uninterrupted, timely, secure, or free of errors. We may modify, suspend, or discontinue any part of the service at any time, and we may add or remove features without notice.

We may also update these terms from time to time. When we do, we will change the date at the top of this page, and if the changes are significant we will let you know in the app. Continuing to use Myloe after the changes take effect means you accept the updated terms.

Disclaimer of warranties

To the maximum extent permitted by law, Myloe is provided on an as-is and as-available basis, without warranties of any kind, whether express or implied. We do not warrant that the service will meet your requirements, or that any recommendation will suit your particular circumstances.

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you have under the Australian Consumer Law and that cannot lawfully be excluded, restricted, or modified.

Limitation of liability

To the maximum extent permitted by law, IIRONIIC Media will not be liable for any indirect, incidental, special, consequential, or punitive loss, or for any loss of profits, revenue, data, goodwill, or opportunity, arising out of or in connection with your use of Myloe.

We are not responsible for the acts, omissions, goods, or services of any venue or third party recommended or linked through Myloe, including the quality, safety, or legality of anything they provide.

Where our liability cannot be excluded but can be limited, our total liability to you for all claims arising in any twelve month period is limited to the greater of the amount you paid us for the service during that period, or one hundred Australian dollars.

Indemnity

You agree to indemnify IIRONIIC Media against any claim, loss, liability, or expense (including reasonable legal costs) arising from your breach of these terms, your misuse of the service, or your breach of any law or the rights of any third party.

Termination

You can stop using Myloe at any time, and you can delete your account from within the app. When you delete your account, we handle your data as described in our Privacy Policy.

We may suspend or terminate your access to Myloe, with or without notice, if you breach these terms, if we are required to do so by law, or if we discontinue the service. Any provisions that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, and indemnity, will continue to apply.

Governing law

These terms are governed by the laws of the Australian Capital Territory, Australia. You and IIRONIIC Media submit to the non-exclusive jurisdiction of the courts of the Australian Capital Territory and the courts competent to hear appeals from them.
